1. Acceptance and eligibility
These Terms of Service (“Terms”) are an agreement between you and Warhorse Media, LLC (“Warhorse Media,” “we,” “us,” or “our”). By accessing a service that links to them, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
You must be legally capable of entering this agreement. If acting for an organization, you represent that you can bind it. A parent or guardian must authorize use by anyone lacking legal capacity to agree independently.
2. Our services
Warhorse Media develops original media, publishing projects, applications, educational products, websites, and related experiences. “Coming soon” and “In development” describe planned or active work; they do not guarantee a release date, format, feature, price, or availability.
We may add, modify, suspend, or discontinue features. Product-specific terms, application licenses, retailer terms, preorder terms, or purchase policies may also apply. More specific terms control for the applicable product if they conflict with these Terms.
3. Intellectual property
The services and their content—including Warhorse Media branding, The Legacy Protocol, names, characters, stories, lore, artwork, audio, video, interfaces, software, text, graphics, logos, and compilations—are owned by or licensed to Warhorse Media and protected by law.
We grant a limited, personal, revocable, nonexclusive, nontransferable license to access public services for lawful, noncommercial use. No ownership transfers. Without written permission, you may not reproduce, distribute, publicly display, publish, license, sell, scrape, train a model on, create derivative works from, remove rights notices from, or commercially exploit our content. Ordinary links to public pages are permitted.
“Warhorse Media,” “The Legacy Protocol,” associated logos, and other source identifiers are marks of Warhorse Media or their owners. No trademark license is granted.
4. Acceptable use
You may not violate law or rights; access nonpublic systems or data without authorization; interfere with security or availability; introduce malware or automated abuse; impersonate others; harvest information contrary to access controls; circumvent technical, territorial, or purchase restrictions; or use our services for unlawful, deceptive, infringing, or harmful activity.
We may restrict access when reasonably necessary to protect services, users, rights, or legal obligations.
5. Store, products, and purchases
Current Store
The current Store is a preview catalog and does not operate on-site checkout. Products labeled “Coming soon” or “In development” cannot be purchased unless an active purchase or retailer link expressly states otherwise.
Future direct sales
If direct sales are enabled, the product page and checkout will identify price, format, delivery, taxes, restrictions, refund or cancellation terms, and applicable licenses before purchase. We may correct errors and reject or cancel orders for suspected fraud, legal restrictions, inventory problems, or other legitimate reasons.
Digital and physical products
Digital books, audiobooks, applications, and downloads may be licensed rather than sold. Unless specific terms say otherwise, they are for personal, noncommercial use and may not be redistributed, resold, publicly shared, or used to bypass access controls. Physical-goods shipping estimates are not guarantees; returns, damaged goods, risk, title, and warranties will follow the terms disclosed at purchase and applicable law. Nothing excludes rights that cannot legally be waived.
6. Third-party services
We may link to approved independent retailers, app stores, platforms, social networks, and video services. Their own terms, privacy policies, pricing, fulfillment, returns, and account rules apply. A link does not mean Warhorse Media controls or endorses every aspect of that service.
Transactions through an approved third-party provider are with that provider or the seller identified at checkout, except when Warhorse Media is expressly identified as seller of record.
7. Disclaimers
To the maximum extent permitted by law, services are provided “as is” and “as available.” Warhorse Media disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted or error-free operation.
Creative and entertainment content is not professional advice. Educational products support learning but do not guarantee examination results, government decisions, legal status, or other outcomes. Government requirements may change; consult the relevant official source. Some jurisdictions prohibit certain exclusions, so they may not all apply to you.
8. Limitation of liability and indemnification
To the maximum extent permitted by law, Warhorse Media and its owners, officers, employees, contractors, licensors, and providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, or opportunities arising from the services.
Where liability cannot be excluded, aggregate liability for a free service will not exceed US $100. For a paid product purchased directly from Warhorse Media, aggregate liability will not exceed the amount paid to Warhorse Media for that product during the preceding twelve months. These limits do not apply where prohibited.
To the extent permitted by law, you agree to indemnify Warhorse Media from third-party claims and reasonable costs caused by your unlawful misuse, your content, or material breach, except to the extent caused by Warhorse Media.
9. Governing law and disputes
Before a formal claim, both sides agree to try in good faith to resolve it for at least 30 days after written notice, unless immediate relief is necessary or law prohibits this requirement.
These Terms are governed by the laws of the U.S. state where Warhorse Media, LLC maintains its principal place of business, without conflict-of-law rules, except where mandatory consumer law controls. Judicial proceedings must be brought in a court serving that location unless applicable law permits otherwise. Nothing limits nonwaivable consumer rights or appropriate relief for intellectual-property misuse, security violations, or unauthorized access.
10. Changes and contact
We may update these Terms as services or legal obligations change. The “Last updated” date identifies the current version. Material changes will receive notice where required. If a provision is unenforceable, it will be modified or severed while the remainder continues. Failure to enforce is not a waiver.
Send questions through the contact form and include “Terms Question.”
